1. About us
Split Pin Engineering is the trading name of Jason Wilson, a sole trader providing welding, steel fabrication, maintenance and repair services from Palmerston North, New Zealand, to customers across the wider Manawatū. In these terms, "we", "us" and "our" mean Split Pin Engineering. "You" means the person visiting this website, asking for a quote or engaging us to do work.
Because we're a sole trader, the person you deal with is the person who runs the business and does the work. If we're registered for GST, our GST number is shown on our quotes and invoices.
This page has five parts: how we handle personal information (our privacy policy), the terms that apply to quotes and jobs (our terms of trade), what we guarantee about our work, how this website uses cookies, and the terms for using this website.
2. Privacy policy
We respect your privacy. We collect, use, store and share personal information in line with the Privacy Act 2020 and its Information Privacy Principles. As a sole trader, the owner of the business is responsible for privacy matters and is the person to contact about them.
What we collect
- Contact details: your name, phone number, email address and the address of the site where work is to be done.
- Job details: descriptions, measurements, photos, drawings and anything else you send us about the work you need.
- Vehicle and equipment details where relevant to the job, such as make, model and registration for trailer, truck or vehicle work.
- Business records: quotes, invoices, payments, correspondence and notes about the work we've done for you.
- Technical information that your browser sends automatically when you visit this website (see cookie policy).
We collect this information from you directly when you call, text, email, use the quote form or meet us in person. We may also note details we observe on site that are relevant to the job, such as access or hazards.
Why we collect it and how we use it
- To respond to your enquiry, visit your site and prepare a quote or estimate.
- To carry out, deliver and install the work, and to order materials and arrange services such as galvanising or powder coating.
- To invoice you, receive payment and recover overdue amounts.
- To keep the business, tax and accounting records the law requires.
- To contact you about your job, including follow-up, warranty or safety matters.
We don't sell, rent or trade your information. We don't add you to marketing lists. If we ever want to contact you about something unrelated to your job, we'll ask first.
You don't have to give us your information, but if you don't, we may not be able to quote for or complete the work.
Who we share it with
We only share personal information when it's needed for your job or required by law. For example:
- suppliers and subcontractors, such as a steel merchant delivering to your site or a galvaniser or powder coater handling your parts;
- our accountant, bank and Inland Revenue, for tax and accounting purposes;
- a debt collection agency, if an invoice remains unpaid after we have followed it up;
- certifiers, councils or other authorities, where the work needs a consent, certification or inspection;
- insurers, lawyers or government agencies, where needed to manage a claim or required or permitted by law.
Where it's stored
We use reputable online services to run the business, including email (Google Gmail) and website hosting (Vercel). These providers may store information on servers outside New Zealand, including in the United States. We choose providers that protect information in a way that, overall, gives safeguards comparable to the Privacy Act. Paper records are kept securely at our premises.
Security and how long we keep it
We take reasonable steps to protect personal information from loss, misuse and unauthorised access, including password-protected accounts and devices. We only keep information for as long as we need it for the purposes above. Business and tax records are generally kept for at least seven years, as required by New Zealand tax law. After that, we delete or securely destroy them.
If a privacy breach happens that is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and the people affected, as the Privacy Act requires.
Photos of our work
We may photograph completed work for our portfolio, this website and our social media. We won't publish photos that identify you, your home address or a vehicle registration without your consent. If you'd rather your job wasn't photographed, tell us before we start. If a photo of your job is already on this site and you'd like it removed, let us know and we'll take it down.
Accessing and correcting your information
You have the right to ask for a copy of the personal information we hold about you and to ask us to correct it if it's wrong. Contact us using the details at the end of this page. We'll respond as soon as we reasonably can, and within 20 working days. We may need to confirm your identity first. We don't charge for these requests.
Complaints
If you have a concern about how we've handled your information, please contact us first so we can try to put it right. If you're not satisfied with our response, you can complain to the Office of the Privacy Commissioner.
3. Terms of trade
These terms apply to every quote, estimate and job carried out by Split Pin Engineering, unless we agree otherwise in writing (a text or email counts). If a written quote or contract for a particular job says something different, the quote or contract applies for that job.
Quotes and estimates
- A quote is a fixed price for the work described in it. An estimate is our best guess at the likely cost and may change as the job goes on. We'll always tell you which one you're getting.
- Quotes are valid for 30 days from the date they're given, unless the quote says otherwise.
- Quotes are based on the information, measurements and site conditions known to us at the time. If those turn out to be different, the price may change. We'll talk to you before going ahead.
- Steel and other material prices can change quickly. If material costs rise significantly before you accept a quote and we order materials, we may need to re-quote.
- Prices for household customers include GST, unless the quote clearly says otherwise.
Accepting a quote
You accept a quote by telling us to go ahead (in person, by phone, text or email) or by paying a deposit. Once accepted, these terms form the agreement between us for that job.
For residential building work that costs $30,000 or more (including GST), we will give you a written contract and the information the Building Act 2004 requires before the work starts.
Changes to the job (variations)
- If you ask for changes, or we find something we couldn't reasonably have known about when quoting (such as hidden rust, damage or different ground conditions), the extra work is a variation.
- We'll explain the change and its likely cost and get your agreement before doing extra work, except where urgent work is needed to make something safe.
- Variations are charged at our usual rates plus materials, unless we agree a price for them.
Deposits and payment
- We may ask for a deposit before ordering materials or starting work, especially for larger or custom jobs. The quote will say how much.
- Unless otherwise agreed, payment is due within 7 days of the invoice date. Smaller jobs and repairs may need to be paid on completion or collection.
- For longer jobs, we may invoice in stages as the work progresses.
- If an invoice is overdue, we may pause further work until it's paid. To the extent the law allows, you agree to pay the reasonable costs of recovering overdue amounts, including debt collection costs.
Timeframes
We'll give you our best estimate of when your job will start and finish. Timeframes can be affected by weather, material supply, third-party services such as galvanising, and other jobs. We'll keep you updated if things change, but we're not responsible for delays outside our reasonable control.
Cancelling a job
If you cancel a job after accepting a quote, you'll need to pay for work already done, plus any materials or services ordered for your job that can't be cancelled, returned or used elsewhere. We'll refund any part of your deposit that hasn't been spent on these.
Ownership and risk
- Goods we make or supply remain our property until they're paid for in full. Where the Personal Property Securities Act 1999 applies, you agree we may register a security interest over those goods until we're paid.
- Risk of loss or damage passes to you when the goods are delivered, installed or collected, whichever happens first.
- Completed goods should be collected within 14 days of us telling you they're ready. We may charge a reasonable storage fee for items left more than 30 days after that.
Your responsibilities
- Access and safety: give us safe and reasonable access to the site, and tell us about any hazards, underground services, boundary issues or other people working on the site.
- Consents and approvals: unless we agree in writing to arrange them, you're responsible for any building consent, resource consent, pool barrier approval or other approval the work needs, and for checking boundaries.
- Vehicles and trailers: registration, warrants and certificates of fitness, and any certification needed for a new build or modification (for example, low-volume vehicle certification or heavy trailer certification) are your responsibility unless we agree otherwise. We build to the specification agreed with you, but we can't guarantee the decision of an independent certifier.
- Your materials and parts: if you supply materials or parts, they're used at your risk. We're not responsible for faults in them or for extra work caused by them.
- Your property: remove vehicles, valuables and anything else that could be damaged from the work area, especially where grinding, welding or cutting will take place.
Liability
Nothing in these terms limits any rights you have under New Zealand law that can't be excluded (see Workmanship & warranty). Subject to that, and to the extent the law allows:
- we're not liable for indirect or consequential loss, such as loss of profit, income or use, or downtime; and
- our total liability for any claim relating to a job is limited to the price paid for that job.
Sorting out problems
If you're unhappy with any part of our work or an invoice, please tell us as soon as possible. Most problems can be fixed with a conversation. If we can't resolve it between us, either of us may take the matter to the Disputes Tribunal or use another dispute resolution process allowed by law.
4. Workmanship & warranty
We stand behind our work. If something we've built or repaired isn't right, contact us and we'll inspect it and put it right where we're responsible.
Your rights under the law
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Contract and Commercial Law Act 2017 or, for residential building work, the implied warranties in the Building Act 2004. Under these laws, our services must be carried out with reasonable care and skill, and the goods we supply must be of acceptable quality and fit for the purpose you told us about.
What isn't covered
Our workmanship guarantee doesn't cover problems caused by:
- misuse, overloading, accidents, or use for a purpose other than the one the item was built for;
- a lack of reasonable maintenance, or normal wear and tear;
- corrosion of bare or painted steel that hasn't been maintained, particularly in coastal, farm or chemical environments;
- modifications or repairs made by someone else;
- materials or parts you supplied, or designs or specifications you provided; or
- ground movement, storms, flooding or other events outside our control.
Hot-dip galvanising and powder coating are done by specialist suppliers. Variations in the colour, sheen and surface of galvanised steel are a normal part of the process and aren't a defect. Where a supplier provides its own warranty, we'll pass on the benefit of it to you.
Making a claim
Contact us as soon as you notice a problem, with a description and photos if you can. Please don't get someone else to fix it before we've had a chance to look, unless it's an emergency, as that may affect your rights.
Business customers: if you acquire our goods or services for the purposes of a business, we both agree that the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, to the extent permitted by law. We agree this is fair and reasonable. This doesn't affect our commitment to fix faulty workmanship.
